Am I eligible for the McCloud Remedy?

The McCloud remedy affects NHS pension scheme members who: 

  • Were in service before 31 March 2012 and on or after 1 April 2015
  • Have taken pension benefits and retired since 1 April 2015
  • Are deferred members returning within five years

What is the McCloud Judgement?

The McCloud Judgement was a 2018 Court of Appeal ruling which found that transitional protections introduced during the 2014 and 2015 public service pension reforms were discriminatory.

The Government introduced the McCloud Remedy to correct this age discrimination across affected schemes, including the NHS Pension Scheme.

Members can choose whether they receive legacy or 2015 scheme benefits for the remedy period, with most making this decision at retirement. Those who have already retired may receive a personalised RPSS from NHS Pensions.
